Original Title
To provide for child support for a homicide victim's surviving dependent child when the defendant was driving or boating while intoxicated at the time of the homicide; And to establish Bentley's Law
Summary
What it does
This bill would allow a court to order a person convicted of homicide while driving or boating intoxicated to pay child support to children of the victim up to 18 years of age (or up to 19 years of age if the child is still in high school). If the defendant is in jail and unable to pay, they will have up to 1 year after release to set up to begin paying support, including any that accumulated while they were in jail. Civil judgments may offset the amount of child support owed. This is the second bill filed this session on this subject.
